Looks to me like even more creative ways to collect revenue. Kinda like the plan to have city police officers weighing trucks. For all the promises mayor mike has made, he will need to seperate money from the wallets of the “good folks” that elected him.
It’s confusing to me. I wonder if this is something they approve each year as a housekeeping thing or if this is Huether’s attempt to ‘crack down’ on code violators. Seems kind of pointless considering they have no constitutional authority to fine people right now. I say trim away and send me the bill, it will end up in the garbage.
A special assessment is a property lien. This is how they intend to bill people for trash removal, mowing, etc.. In other words, you must settle when you sell your property or they’ll seize the equity or title.
It’s sophisticated and cute but do this.
– They can’t come onto your property without a court order and they can’t get one until they prove they have amended ordinances to comply with constitutional law.
– Home Rule restricts their actions to a $600 fine. Any other sort of penalty (this) is unconstitutional.
– It’s not a good idea to keep equity in real estate inside the city limits. Mortgage out to the max. When the market improves, move into a neighboring democratic city.
– Bank out of town. The city has been attaching bank accounts. It’s not legal but banks are going along with it.
It’s getting bad. I suspect the council sees through this but they’re powerless against a legal dictator mayor. When there’s a mass taxpayer migration to outlying areas, they’ll change government and restore democracy.
Mikey is a little kid. His actions are predictable and he should be spanked often. Cut off his allowance and make him go to his room at city hall for another 42 months.
I suspect ‘My Bureaucrat Mike’ has discovered he has all the power in city government. It’s possible to clean up blight but it must be done legally and democratically. Home Rule Charter is neither. There’s a strong landlords group I’m assuming is onto this.
Considering this and 2 other court cases, Mike’s big plans could easily turn into ‘Nothing but litigation’. He’s headed down a hiking trail with an 18 wheeler.
I suspect the council is clueless but they can’t do anything anyway. They still have one important power, they can initiate a new ordinance. There’s nothing relative to mayor recall. They’re going to need it.
It is general housekeeping stuff…. nothing new.
PG – you are starting to resemble a raving conspiracy theorist with far more assumptions than fact. Your problems were not created by Mike but rather people in place long before he arrived, so give him a chance to fix at least part of the issue before going off on your daily rant.
You are right Costner, it is housekeeping stuff, someone verified it to me.
I also heard that Huether is stepping up code enforcement and handing out violations. I guess the city likes lawsuits.
I hope you’re right. I’ve learned not to trust the city and suspect something devious. It sounds like a Tornow.
There should be more explanation. If these actions are on public property or right-of-way, OK. If not, get out your shotgun and run off the revenuers.

Yea… that would end well. Private property or not, “castle doctrine” doesn’t apply if your life isn’t in danger or if you can’t prove the person was attempting to commit a felony against you in the great state of South Dakota. Look it up if you wish: SD Codified Laws 22-16-34
If you so much as display a weapon or point it at someone who isn’t trying to kill you or at the very least engaged in a felony at the time on your property – chances are you will be the one headed to jail rather than them.
If you threaten someone with that weapon the charges would be even more severe up to and including prison time. Pretty tough to “fight the man” when you are sitting in a jail cell.
I was kidding. No thanks for the lecture.
I think people should keep arms so intruders suspect what to expect. The city is just another intruder when it comes to entering onto private property without a court order. It should be extra points.
