What did SF City Hall do to piss off the SD Supreme Court?

Oh, that’s right, they continue to wipe there ass with the US and State constitutions;

SIOUX FALLS, SD – The South Dakota Supreme Court says the city of Sioux Falls exceeded its authority when it enacted a zoning ordinance controlling the location of businesses seeking to place video lottery machines in their establishments.

The justices agreed with a lower court ruling that regulation of video lottery is a state function to the exclusion of municipal regulation.  Casino owner Rick Law sued the city after it sought to regulate where he could open new casinos.

The justices in their decision said municipalities are not given the power to license video lottery establishments or otherwise control the location of such establishments.  But they said municipalities do have the power through zoning to control the location of alcoholic beverage establishments.

Agree or disagree with video lottery, doesn’t matter. The state controls the number of machines a business can have. When the council voted on this I knew they were barking up the wrong tree. I think Quen Be De Knudson said something like, “Bring on the court challenges.” Another genius move by De.

We recently asked city councilors to explain their vote in reference to the recent termination of city clerk Debra Owan;

THE THREE COUNCILORS THAT VOTED AGAINST HER TERMINATION

Denny Anderson Jr. Junior, “So they caught Debra picking her nose one time during a council meeting. So f’ing what? Oh, I mean, I can’t talk about the details? Sorry.”

Vernon Touchofgrey, “Debra has been my Joan of Ark, and I hope I have been her Knight’s Templar.”

Craig Jammerson, “I thought we were voting on replacing Bob Litz and got confused.”

THE FIVE COUNCILORS THAT VOTED FOR HER TERMINATION

Dan Karskye, “You, know, the business I am in, selling insurance, it is kinda based on speculation. So I used an old insurance company standard, tried and true procedure, the Magic 8-Ball.”

Tim Antenman, “I can’t really go into great detail, but this stems from a deal I made with the Hell’s Angels years ago. Sorry Debra, you just can’t break a deal with these guys.”

Marilyn Erpenslopp, “It’s none of your business. But I will tell you this, my decision was cultivated by integrity, honesty, be-jeweled glasses and a jealously of Debra’s long blonde hair.”

Sue Agriculsure, “Okay, so I had Marilyn yelling at me, and Mike yelling at me, and Denny farting on me and after a three hour meeting I was craving the Diner’s hot turkey sandwich, and I had to just get out of there, so I voted yes . . . or did I vote no? Not sure?”

Tex Golfing, “I’m in the same bizzo as Karskye, and would have to agree, we use some tried and true procedures. But I don’t use the Magic 8-Ball, that’s small potatoes, us big wheels like the Ouija Board.”

THE MAYOR WHO ‘FACILITATED’ THE MEETING

Mike Heeter, “I can tell you f****** honestly that I did not f*** the chicken on this one. I was there to simply make sure s*** was going down correctly. As for the ‘raised voice’ that many people heard beyond the walls. Not sure who that was, but the police were called in to escort that person away.”

MK, “Weren’t you escorted by the police to your vehicle that night?”

Voters realized they didn’t pick the lesser of two evils in the congressional race

Oh shit! I have to run against Steffy again?!

Had to chuckle;

In a following question, NBP asked South Dakotans whom they would vote for “today” in an election between incumbent Noem and Stephanie Herseth Sandlin.  Herseth Sandlin, who was narrowly defeated by Noem (48% to 46%) in the 2010 general election, wins handily today, with 58% support to Noem’s 37%. 5% are undecided.

Of course it didn’t take the Dems long to jump all over this;

“Voters don’t have a case of buyer’s remorse,” says Ben Nesselhuf, Chairman of the South Dakota Democratic Party. “They have a full blown case of buyer’s depression.”

I voted for Thomas Marking and got accused last night of ‘throwing’ the election for SHS by a former SD politico. I won’t name names, but I did tell him that he was wrong. I told him that most people who supported Marking were libertarian and conservative in nature and would have more likely voted for Noem.

Besides, if Steffy was such a great congressperson she should have been able to squeak by Noem easily. Steffy, think big hair and hoop earrings.

Mayor Huether continues his push for more yes MEN

Can’t wait to see this list of rubber stampers;

Mayor Mike Huether on Thursday will announce two new appointments to the Airport Authority Board.
