I watched the SD Supreme Court hearing on the big yellow house (FF to about 2:10) today.
From listening to the 3 different attorneys (Plaintiff/Defendant/State Historical) I got the feeling that not only the Sapienza’s were guilty of being purposely sneaky in building the house, the city of Sioux Falls pretty much ignored repeated complaints from the McDowells.
So what’s next? We have to wait for the Supreme Court’s decision, which I think they will agree with Pekas to either fix the house, demolish it or move it. Then what?
Well, the Sapienza’s could sue the city, so could the McDowells. I have feeling the big yellow house will be around a little longer, for now.

Here’s what I don’t get: Sioux Falls is a town that all but requires a permit to change a light bulb–how the heck did “the monster house” ever past the watchdogs?
Yes, Joe Sixpack needs a permit for everything, Sanford Doctors, not so much. In all fairness though, it seems they got granted ‘too many’ permits.
But it happen in McKennan Park, everything is just perfect there…. It’s magical and charismatic….. No questions need to be asked when one is in McKennan Park…. Because why question perfection?… Just enjoy….
City ordinance states ‘subject to judicial review’ not ‘appeal into circuit court’. There’s doubt the city can be sued. They consider themselves their own legal authority. Theres no appeals and they are not subject to court judgement. You can’t sue them and they can’t sue you. It’s why this case ended up in state court on constitutional premise. Likely, there will be a decision but the house will remain as built.
Could just hire hultgren to paint it = pile of rubble in seconds.
