I have watched the video of Mark Burgress being arrested several times, and there seems to be a lot of misinformation about what is actually in the video. We all know Mark was a cussing moron, that’s apparent. We also know that a judge could find him guilty of disorderly conduct (if police can actually prove he was interfering in their investigation), but some people, including Belfrage are trying to say there are other things happening in the video that are not.

For instance he said Mark was preventing the police investigation of the traffic accident. I didn’t see that. He was standing on a public sidewalk cussing, and they were actually about ready to leave the site before arresting him. Not once did I ever see Mark walk into the scene and try to physically interfere.

He also said they were questioning him, watch the video, they were trying to grab him even though they had no reason to. There is a difference between keeping a safe distance and questioning someone and trying to detain them. At no point did Mark ‘threaten’ the police with violence or with a weapon.

Belfrage also says that you should always follow police instructions. Not the case. While police have a right to ask bystanders questions, you have a right to NOT answer the question. Immediately after asking Mark a question they try to detain him before he can answer. Refusing to answer a question, as Mark did, is not a reason to arrest or detain someone. Mark actually asks them why they are trying to grab him, they have no response.

While we can certainly DEBATE the incident, let’s debate it on what actually happened in the video.

  1. Let him have his day in court. His jail time and bond has hopefully taught him to watch his vulgarity and interference. Ultimately, the judge will professionally sort this out. I suspect his sentence will be time served and a stern warning. He’s earned a police record and it’ll be easier to take him in to custody next time.

  2. It is not a free country. Huether often false arrested citizens because they were homeless or were about to make a public comment statement at council meetings. Trump will pardon those indicted from the Mueller investigation.
    If you’re a person in power (including police), you can enslave the general population.
    Get a haircut, Hippy, and fall into the end of the Line with the rest of us.

  3. A law professor once told me and my fellow classmates that a police officer has the ultimate sovereignty… But then again he said that when video cameras were fairly new, smartphones did not exist, and the Rodney King incident wouldn’t happen for an other five years.

    If you watch the police briefing from yesterday, one cannot help but notice that they have tried to change an “investigation” into “containing.” And the fact that the largest TV station in town didn’t touch this story until the briefing is a very chilling reality as well. The totality of these two realities is very troubling to me even if it finds me defending someone who tells the police to “fxxk off.”

    No wonder we have Bunker Ramps in this town, a construction worker’s death not thoroughly investigated by a local prosecutor, and an exterior on a new events center which is in much worse shape than the exterior of an older arena that many of the “powers to be” want to tear down. I am afraid we continue to live in “A Tale of Two Cities,” where continual incidents back up this unfair reality……. (“But we do have some Arcs and that Levitt thing…Those things are cool though.”)

    Trust me foxybear, if the PD had that on their side they would have mentioned it at the briefing to cover their you know whats.

    I have made a lot of comments on this matter, as have others, on this blog site, but the bottom line is that probable cause does not exist in this incident; and without PC the officer’s actions are unwarranted in more ways than one.

  7. I’m not defending ‘anyone’ in particular, I’m defending the 1st Amendment. Besides, the last I checked, the only thing Burgess was armed with was a double-barrel middle finger.

  8. Hmm. I guess I would have to see the letter. If it was a case of persona non grata, they really can’t ban him with out a signed court order by a judge. I also find it interesting that an elected official posted a cartoon about harming elected officials. I also wonder what this has to do with Yankton city officials? Did he actually threaten to harm them? Otherwise while in bad taste and poor judgement (like the guy above in the video) I think it is protected free speech.
