As you know, I have been trying to find out why Superlative’s contract with the city was terminated early (They did the market analysis for naming rights on the new EC).
I finally was able to attain the original contract with the city, and from all accounts, while I disagree with the city for terminating their contract early, I don’t see that the city did anything wrong by this early termination.
SECTION TEN of the contract is pretty clear;
While Superlative has a right to be upset about the early termination, after all the work they performed for the city, they also got paid very well to perform this work. And hey, at the end of the day, who cares if Legends or Superlative announce the ‘S’ word Events Center?
UPDATE: I received this email today from SF Finance Director, Tracy Turbak about the bond sale;
Scott –The City raised $102 million of the $115 million needed for the Events Center Project through a tax-exempt bond sale on March 13th. Â The bonds were sold by the City through a competitive bid process. Â There were eight bidders and the bid that resulted in the lowest overall cost to the City was submitted by a syndicate of 22 investment firms led by Robert W. Baird & Co. Â This syndicate, or group of investment firms, purchased the entire bond issue at an overall interest rate of 3.21%. Â These investment firms, called underwriters, then re-sell the bonds to either institutional or retail investors. Â The bond holders are free to trade the bonds on the open market, but that secondary market trading does not involve or impact the City in any way.
The balance of funds needed for the Events Center Project will be raised by a taxable bond sale later this year – the exact sale date has not yet been established. Â This second and final bond sale will raise $12.5 million for the project ($.5 million is being funded with City cash on hand) through the same competitive sale process.
Let me know if you have any further questions.
Thanks,
Tracy
The only reason either is paid is because they’re a method for Huether to stream kickbacks. Neither has to be paid because city ordinances do not allow court action. Daniels Construction was not paid for cafe remodel at the falls. They made the mistake of submitting a low bid without insider payoffs. Warning, do not bid on city projects. You’ll not get paid unless/until competative bid process returns and the city returns to a democratic form of government.

Sent twice. Droid is not blogger friendly
In what reality do you deserve to be paid for making a bid?
Talk about kickbacks, that would be one.
I don’t know about that situation but your description is either dubious or painful for those of us participating in English.
As I said before, awfully bold to take our money, finish last in a competitive process and then complain publicly. Although something tells me they didnt complain publicly, they were found by somebody with an agenda.
this Jim Daniels sounds like a piece of work.

Most people don’t think much for people that file frivolous lawsuits but they are heroes to the southdacola coffee clatch.
Agenda? What’s my agenda Justin? Money? Power? LOL!
to make life miserable for every public official who doesn’t acknowledge what a great citizen you are for attending all the city meetings.
it’s really not a bad angle from a utilitarian standpoint, it just grates on me.
OK justin…Daniels is a crook. Anyone who is at all familiar with dealing with contractors knows this, especially if you’re a subcontractor trying to collect from the guy. Just what does your rant have to do with DL’s post?
I would think I’m considered a member of this coffee catch, but I’ve never heard of this guy.
Poly it was in response to Pathloss.
First off Justin, or as I affectionately call you to myself, numb nuts (and I am being nice). I have never received so many email complaints about a commenter before. Even when PL is at the top of his rant game, I haven’t gotten that many complaints.
My readers, they don’t like you, AT ALL. I actually like you on here though. So, I won’t block you for now.
As for this comment;
“to make life miserable for every public official who doesn’t acknowledge what a great citizen you are for attending all the city meetings.”
Yeah, pretty funny. Last week I had several email exchanges with our mayor, and yesterday I talked to 3 different councilors about several topics including education, arts and the EC. Believe it or not, some of them may not like me, but they DO talk to me and ask me my opinion on topics.
Gotta’ admit that ol’ numb nuts has been fantastic for to drive up the web traffic to your site !
Nails on a chalkboard. Listening to HisManMike(TM) blab during recorded videos of his Shut-up and Listen sessions. Reading Justin’s pretentious comments.
All on the same level, yet so captivating.
I wish I could quit you.
That one stung, didn’t it?
… fantastic to drive …*
Maybe you just become better at conversation. If you insult me inviting me to insult you back you are going to lose all day.
l3wis-
You should considered adding a new tag catagory: Justin. Or, if you prefer less offensive pejorative, perhaps ass clown or douch hammer would suffice. Food for thought…
Very eloquent and biting.
I’ll name you Billion Dollar Bond.
I like it!
If you can sell the movie rights to your life now you’ve got a title.
I find the fact that one poster saying a few things that some may not agree with is suddenly considered a bad thing. I guess I was under the impression differing opinions led to a better conversation. Most of us are guilty of being somewhat close-minded from time to time, so having someone disagree with you is not always a bad idea.
God knows I’m not always in agreement with l3wis, but I still respect his opinion. Same is true for many others including Dan, Dave, and yes even Justin.
The fact people actually take the time to email l3wis to complain about him is just sad. What is this… junior high where students have to tattle on each other? If you don’t like what someone says by all means speak up and explain why they are misguided, but don’t run to mommy and tell her that little Johnny is being a big meany head. Grow a pair – the world is full of people who probably don’t like you and who probably disagree with you. Trying to avoid them your entire life only leads to disappointment.
That said I’ll agree I don’t read every comment on every post so perhaps I missed something, but from what I have seen Justin isn’t trolling, he isn’t any more offensive than anyone else, and even when I might disagree with him his comments seem like he has put some thought into them which is more than I can say for a lot of people. I guess I don’t understand all the fuss – and I surely don’t find the name calling and labels to be something people should be proud of.
“The fact people actually take the time to email l3wis to complain about him is just sad.”
I sorta agree, I have tried to keep this a place of free discussion. And while Justin has said some pretty ludicrous things, he has made some good points, and he keeps it pretty clean, cleaner then me.
Well stated Craig. Justin, my apologies for for the disparaging remarks. You have made valid points in the past. I just wish you had the capacity to acknowledge valid points made by others, particularly when it’s accompanied with a legitimate source. I have admitted when I’ve been. Can you?
Err… “I have admitted when I’ve been [wrong].”
I don’t think either of us were wrong. They typically lose a little money which I never denied.
Some of them make money, which you never denied.
Where we were both wrong is trying to claim the other denied something we didn’t.
Good points, Craig. … and I am not among those who have petitioned Lewis RE: Justin’s posts. Hell, I’ll watch a NASCAR race simply to see the big wreck!
Nonetheless, I am mindful of this as Justin’s initial salvo on South Dacola:

I am not a devout partisan for Staggers, nor do I have a dog in the gay pride vs anti-homosexual fight. But, this struck me as an odd way to issue an ice-breaker toward ‘conversation’.
Nothing like walking into a man’s camp; pissing on his campfire; then pulling up a camp chair to have ‘conversation’.
The image of the proverbial bull in a china shop comes to mind.
sounds like I was pretty spot on then.
It might also be the fact that I had posted here before on the very topic the day after the election.
