As I have said all along, this gigantic ordinance change should have been broken down in sections for the council and public to pass, instead, like most things with this administration, they needed to ram rod it through all at once. I encouraged people to vote down Shape Places in the past municipal election not just because of Walmart, but because it had several flaws, that needed to be fixed in sections. Of course, the voters didn’t understand that, so here we are (Full DOC: billboards);
WHEREAS, the City hereby exercises its authority under SDCL 9-29-1, SDCL Ch. 11-4, and the City Charter, to establish an immediate and interim moratorium on the installation of any Billboards or the issuance of any permits for Billboards within the City;
WHEREAS, an interim moratorium will ensure that any proposed zoning ordinance changes and any proposed amendments to the City’s 2035 Comprehensive Plan can be completely examined with adequate public input from citizens, business interests, and sign industry representatives;
WHEREAS, the City finds that an interim moratorium period of 180 days is reasonable to preserve the status quo and prevent significant investment pending the outcome of the above study and any proposed regulations emanating therefrom;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. Interim Moratorium.
The City shall not accept or process applications, issue permits for, or allow the installation of any Billboard for a period of 180 days, or sooner if this Ordinance is repealed by the City at the completion of the above study.

Does anything the city dictates matter? Look at all the unofficial used car lots. Their appeals process doesn’t allow for court action. They have no power without the courts. It’s a loud bark but no bite. Rather than endure the approval process, it’s easier to implement and become approved via time. The sign thing is a joke and just another foolishness for adding more budget to the city attorney. There’s no resolution but they look good fighting against constitutional law.

To this day, when I see in the news some of the faces of city personnel who are and were on the forefront of Shape Places, I am sure my blood pressure goes way up. I would love to see the day when they do not work for the City of Sioux Falls anymore. This latest is a clear indication that they were way in over their heads on Shape Places. And that is being kind.

Oh get over yourself, Scott. Take three seconds to stop stroking yourself over how you think you’re so much smarter than everyone else and how you always know best. It’s obnoxious and in many cases, like when you attempt to flex your legal knowledge, you’re provably incorrect.
Whenever major reform is undertaken, all the parts are interconnected. What you’re proposing is how you end up with Frankenstein-like code monstrosities. Sometimes you just need to blow the whole thing up and start from scratch. That was precisely the case with Sioux Falls’ ridiculous land use system, which I think dated from sometime around Prohibition and didn’t even make allowances for such humdrum classifications as mixed-use development.
Just because that new system invariably needs tweaks and modifications is in no way, shape, or form a wholesale indictment of the original change. We’ve made changes to the Civil Rights Act too. By your half-baked logic, that means we rushed half-assed into the original and never should’ve passed it.

I understand changes should have been made, my point was it should have been done reasonably, now we are going back and trying to tweak things that could have been amended by the council to begin with if it were presented to them in bite size pieces. Ask any councilor if any of them read the entire document before they voted on it. I doubt it.
Shape places is/was just a smoke screen to sneak in indoor sports meccas. Suddenly there’s a public bath house and an indoor Wimbledon called Huether.
I hate changes – especially BIG changes. We’ve got to change the way things are being changed. Let’s change the changes back to before the BIG changes and them make a whole bunch of little tiny changes. We should take about 10 years to change the changes to other changes. That way change can be constant – and everyone can be confused, by all the changes happening all the time, and I can be really angry – because everything is changing all the time. At least my anger can be constant – I love constancy.
