A Sioux Falls man is challenging the city’s HOME RULE charter in a hearing on Friday.

Judge Caldwell will hear arguments on February 13, 2009 – 9 AM.

It should be in courtroom 6 on th 6th floor (not sure yet).

Witnesses in order will be Gary Colwill (former city atty who installed 1994 Home Rule, 9AM)

Kathryn Rockwell (Tornow’s paralegal who signs everything for him, 11AM)

Brad Hartmann (city code enforcement officer, all afternoon)

Shawn Tornow is city’s defense council

Hopefully the MSM will be covering it . . .

Why is he challenging the charter? Did someone with the city piss on his lawn?

  2. I’m not sure really. He has emailed me a few times. I told him I would put the info up, so hopefully he will come on here and comment.

City holds hearings that violate state and federal constitutional rights. Their citations are ‘mailed’, improper service. You cannot call witnesses, present evidence, and must testify against yourself. There’s no official record and you must accept their hearing examiner. In January 2008, codes were changed from ‘appeal to Circuit Court’ to ‘Judicial Review’. No appeals, socialism.

  4. Thanks for the update – I figured it was something like that, but I could not remember. Have you contacted the Argus or KELO about it? I bet Jonathan Ellis from the Argus would love to do a diddy on it.
