From Egg Rolls to Aces

I guess the Pettigrew/Cathedral neighborhood was a bit surprised when this popped up on the agenda;

Petition: CU-014556-2021: Conditional Use Permit for an On-sale alcoholic beverage establishment within 500 feet of a sensitive use located at 523 W 10TH ST.

Notice staff has stayed out of making a recommendation;

While the zoning is appropriate for an on-sale alcohol use, staff are reluctant to provide a
recommendation as the subject area has enough societal challenges with such establishments in
the immediate vicinity. Management of this facility plays a pivotal in being a good neighbor by
educating staff, enforcing policies, and being proactive with law enforcement.

Well that is certainly refreshing, they shouldn’t be recommending approval for any project.

Many in the neighborhood have asked me how this even got on the agenda. This will be an interesting one to watch, but if I was a betting man it won’t pass.

    That’s it!
    This is the only contribution which should be offered by ‘staff’.
    The rest of that included with the agenda item is editorial content, as if the opinion of ‘staff’ should somehow be more influential on this decision than the input from any other citizen who is knowledgable about the zoning regs.

    So, who was the Smart-Ass Commissioner who made the move to adjourn (right after your public input)?!? I did NOT like his tone of voice!

    This is a volunteer position as Commissioner, BUT they need to remember, THEY ANSWER TO THE TAXPAYERS!!!

    I do not believe that “government” can legally restrict any topic from getting on the “Agenda”. They must allow the petitioners or any individual to place their item on the agenda so long as the proper proper process was utilized as per the State Constitution and/or City Charter. The City Charter/ordinances simply say – you need to get no less than 2 City Council Chairs to place the item on the agenda. So long as they go thru the proper petition process, and gain the support of two councilors, ‘government’ cant block it, that would equate to allowing Government to much power. And when I say ‘government’ – I am referring to City Hall or Pierre.

    The mayor’s office, the city council, the city attorney, the city clerk and the planning office all have the right to deny an application. They have done it several times with TIFs, tax rebates, re-zones etc. While I agree with you they shouldn’t have that power, they do.
