Sioux Falls City Council approves land transfer in Public Meeting without providing public supposed confidential legal documents

At the council meeting tonight you will hear a lot of legal mumbo jumbo about ethics ordinances, Supreme Court rulings and executive confidentiality. The problem is that it’s all horse pucky.

I am still of the opinion that the city council CANNOT meet publicly and vote on publicly announced agenda items in a public meeting without sharing the legalities of this land transfer. This is what they were told tonight, that they would essentially be violating ethics rules if they talked about the legalities discussed in executive session in a public meeting.

The whole purpose of having a public meeting to approve an agenda item, any agenda item, is to release that information publicly to the public before it is voted on.

Ethics be damned if you can approve deals like this in a public meeting without giving the public the legalities of the deal. I believe it is a gross violation of public meeting laws and rules and I would have been sitting up there tonight, I would have recused myself from the vote and stated that I would be violating said rules if I voted on it. I found it interesting that one councilor probably knew that since they were absent tonight, or likely they are heavily invested in the project.

When I talk about corruption and openness in government, this is a prime example. It’s what the public doesn’t know that corrupts the process.

I have never been so disappointed and disgusted as I was tonight watching this boondoggle. What makes it even more hypocritical is the very people who benefitted from this top secret land transfer didn’t even have the courtesy to show up tonight. Go figure.

Sidenote; there is a new public advocate in town that moved here from Florida in March who speaks during public input. He is very well spoken and takes the council to task for the issues with housing, public transportation, internet access monopolies and lack of affordable healthcare for self-employed individuals. It only took this person a couple of months in Sioux Falls to smell the lack of leadership in our city government.

Is the City of Sioux Falls secretly planning $40 Million in Quality of Life bonds after the 2022 election?

I got word from some city hall moles yesterday that the Parks Department in cahoots with the Mayor’s office is rumored to be planning around $40 million in quality of life bonds for two new swimming pools (I think outdoor) after the 2022 municipal election is over.

It’s no secret a couple of pools are at their life, but what I find ironic about this rumored proposal is the fact that we can’t even get lifeguards to work for the city, because of low pay and no paid certification.

What makes it even more egregious is that we need to prop up our infrastructure, workforce, housing and crime prevention before we think about building under staffed pools. This is just another handout to contractor buddies of city hall, much like the Bunker Ramp, Admin building, Indoor Pool and Events Center.

When are we going to get a city government that works for the people instead of the developers? This is what happens when you give executive authority to your chief of staff that was a former executive with the largest developer and TIF welfare recipient in the city, and possibly the state. Lots and Lots and Lots of payback.

The running joke amongst my political friends in the city on the right and the left is that the developers run city hall and the city council. Sadly, it’s not a fictional joke anymore, it’s fact.

City of Sioux Falls Public Meeting Agenda for July 20-22, 2021

There are several interesting agenda items, including another IM 26 task force meeting, in the AM during the workweek at the library where it cannot be recorded or easily attended by working folks. The mayor also lays out the budget for the city, even though according to charter this should be the job of the city council. In the regular city council agenda is the 2nd reading for the land swap deal the smells about as bad as the river it borders. If you go look at this land, it is pretty clear it is controlled by the Corps of Engineers and not the city or the property owner.

The article is credited to me and the maps are still true.

The river bed was never owned by anyone but the federal government and since it was part of a navigable it cannot be taken over by anyone without the Corp of Engineers releasing it and likely an act of congress. Sioux Steel never owned the river bed filled in by garbage. The reason the city is not releasing any of their documentation is due to the faulty “quit claim” deeds they might be citing.

The city attorney, Lloyd Companies and Sioux Steel are playing fast and loose with the facts to seal the property permanently. Sioux Steel cannot give away property then never owned. They were and are squatters with no real claims to the property.

The parties to the development including the Sioux Falls city attorney, Lloyd Companies and Sioux Steel must prove they have the rights to continue building on and trading property they do not own or have rights of fee simple.

So if you watch the city council meeting tonight, Item #12 is a land easement deal with the developer of the Sioux Steel project. While that certainly isn’t anything to raise eyebrows over since the city does these kind of deals several times a year, what makes it concerning as you watch the discussion is that the Planning Department, the City Attorney’s office and likely the Mayor’s office hid this information from us and the city council for over 18 months. Wouldn’t this land transfer deal be something that should have been presented to the citizens before BOTH TIFs for this project were presented? What makes it even more interesting is that it seems some of the information remains confidential even though the city is having a public meeting, discussion and 1st vote on this land deal. Remember when they terminated former City Clerk Debra Owen? Deja Vu.

It also gets even more nefarious when you consider that this land transfer will end up costing taxpayers millions more because the land we are getting from the developers will suddenly become river greenway property that we will be responsible to develop.

Luckily this is only 1st reading, and hopefully the council will be able to really dig into what is going on here, and hopefully by 2nd reading some of those secret legal documents will appear.

At first glance, it is my guess that this was kept from the public and the city council for this long because it is NOT a good deal for us, and they tried to skate this as long as they could (or at least until they got their precious TIF).

I keep telling you folks, there is a lot of ‘stuff’ going on behind closed doors at city hall, and it is NOT to our benefit. And the irony is this is all occurring while the head city attorney is rumored to be on an extended vacation – how convenient for him?

Sioux Falls is Full of Boom Town Rats and very few Progressives

Well the ‘Boom Town’ mentality chickens have finally come home to roost;

Sioux Falls Development Foundation is getting creative in reaching out to those living nearby with a social media and mailer campaign. Bob Mundt is the President and CEO.


“It is a tremendous need over the next several years to bring people Sioux Falls to work the jobs that we’re creating and so we’re being really creative as to how we do that, looking at how we can reach out to other communities,” said Mundt.


The campaign is targeting residents throughout the midwest.


“Minneapolis, Twin Cities area, Des Moines, Sioux City, Council Bluffs Omaha, Fargo,” said Mundt. “A lot of production jobs. We need a lot of specialized jobs, skilled level jobs.”


Another challenge for those relocating is finding a place to live.


“I think it’s a challenge that we have, is to come up with a way to have more housing and the affordable housing areas,” said Mundt. “And so I think when we really talk about housing, that’s probably the next big thing. We’re going to have to push hard on is making sure that we have places for those folks to live.”


“We just want people to come to Sioux Falls and become part of our community,” said Mundt.


I really didn’t know when the bomb fire would start burning out of control in Sioux Falls, but it is really starting to roar. It is estimated that for ever 10 jobs available in Sioux Falls there are only 2-4 workers to even ‘possibly’ fill them. This means passing background checks, drug tests and sometimes health screenings. And if you can get pass that, you may have to deal with attendance issues due to child care.


So how did this all happen? I guess I don’t have to do a bunch of scientific economic studies to tell you the obvious reasons. COVID and the national economy along with global warming issues is driving people and businesses to our region, that is unquestionable, but what has put this ‘Growth for Growth’ sakes attitude take hold is from the years of throwing money at developers and especially development parks. We still live in this dream world that trickle-down economics works. It has never worked and never will (except for those on top of the food pyramid). Even before the ridiculous and unneeded $94 million dollar TIF to Flopdation Park, the taxpayers in the State, County and City have dumped well over $50 million in infrastructure into the place. And for what? Thousands of below living wage jobs that cannot be filled. But this is kind of like throwing gas on the fire (in the form of tax rebates, FREE infrastructure upgrades and TIFs) and it has been going on for over two decades and now that we have ‘over attracted’ business here, we don’t have the workers to fill the jobs, the wages to maintain a economically stable middle class community and the housing they need to live here.


The writing was on the wall folks.


One reason I have railed against TIFs for years is that it is a foolish way to spend property TAX dollars. Instead of investing 100% of that money into the entire community (roads, schools, social programs, etc.) the enormous tax breaks go towards the private investors and developers who spend it on propping up their own businesses while we subsidize those rebates and now it seems to the detriment to the rest of the community.

I have felt that if we would have started cleaning up our core, 15-20 years ago, using these same tax dollars, building up density, propping up affordable housing, and investing in local businesses we would be in a much different position now. Would our growth have been slower? Yes, but it would have been more manageable and we would have developed local wealth. Instead of investing in the core, we blew it on Pools, Event Centers, Bunker Ramps, Dirty Railroad land, etc.


But our failures in infrastructure upgrades is just part of the problem.


While I don’t have an issue with bringing folks in from all over the country, or even other countries (diversity is a good thing) I wonder where they will live? In tents?

While we built up businesses (even ones from other parts of the country and world, who pay little to no Federal or state taxes) we neglected affordable housing, affordable neighborhoods, local business and infrastructure, and somehow we think we are going to be able to put out this bomb fire?

It is possible though.


First we would have to change our entire city council and mayor’s office, county commission and school board. We would also have to restructure our city charter. We would also have to put an immediate freeze on all tax rebates and TIFs to developers and businesses (they don’t need any more incentives folks). We also should put a 2-4 year moratorium on NEW quality of life projects (Did you know the Canaries want us to help build a new stadium). We also need to change ordinance so that the city has at least a $11-13 an hour minimum wage, and wage listing requirement in help wanted ads, and a change in zoning and regulation for homes older then 50 years so it is easier to fix up affordable homes or expand them. We also need to focus a majority of the 2nd penny on cleaning up our core and creating more density.


This of course would mean we would have to overhaul our entire structure of government in Sioux Falls and make bold decisions helping the CITIZENS of our city instead of the MONIED elite. I know, a total 180 from how things are done now.


I hate to say it, but it is going to be a rough ride in Sioux Falls over the next 5 years if some of these things are not done. Inflation in housing will skyrocket, property taxes will become unreasonable, crime is definitely going to go up (and not just because of population growth as our Mayor and Former Police Chief contends).
We will also need a change in the mentality of public employees who will need to have more of a culture of customer service instead a culture of kiss ass the mayor.


I have no intention of leaving Sioux Falls, no matter what happens, but we are no longer the big prairie village that can get away with the old white dudes running the town and pillaging the city coffers. We are going to have to make big progressive moves if we are going to come out of this, because the rich old money white good old boys Republican playbook ain’t working.
